3/04/2010 8:31:36 AM

Apple had filed a patent infringement lawsuit on this Tuesday against HTC by claiming that the Taiwanese company is infringing twenty Apple patents. Apple said that the patents are related to the iPhone user interface and architecture of smartphone's and its hardware. HTC phones include the ones, which use Google's Android mobile OS. The lawsuit was filed in US District Court in Delaware and along with the US International Trade Commission.

Apple CEO said that they can keep a watch on the competitors and their ways to steal the patented inventions or there can be something done about it. They have actually made decision for doing something about this issue. There is a healthy competition, but the competitors need to create the original technology and not steal or make infringement for the patents used by other companies.

Apple’s filings make regular reference to HTC Android products, which infringe the patents and ITC filing has also given a listing for exhibiting and making instances of unfair imports for selling HTC devices, inclusive of Pure, Touch Pro, Imagio and Tilt, which runs windows mobile. The lawsuit is the recent string of such patented infringement claims, which are filed by vendors of smartphone. There is in fact a competitive battle in the market and the struggle is for the people who control smartphone market.

While the industry has been giving information about touch screen phones, since the release of iPhone; there is now the availability of other touch screen phones, which is gaining importance amongst people. The phones are designers for being iPhone killers in the market and this is the first time Apple is defending its patents.

The filings from Apple show that it is actually defending its position. Nokia recognized Apple as its competitor in the very similar way and now, Apple is recognizing HTC as its competitor. Nokia presently filed the suits against Apple, thereby charging it with the infringement of patents. Apple introduced its iPhone, it made a point by saying that it have excess of patents on it and would defend them in an aggressive manner. HTC lawsuit depicts the seriousness for doing so.

HTC has presently not yet seen the lawsuit filing and hence, it cannot comment specifically about it. However, the company has been into the process of making phones for years and holds many of its own patents and actually, they value patent rights and their enforcement terms.

Google immediately did not give any response to a request for comment about whether it might get involved in the suits since its software runs some of the HTC phones cited. Microsoft said it has no comment on the suits.
